Mediation Brief

A detailed mediation statement is due one week before the mediation and the parties are encouraged to exchange those statements. In order to prepare everyone for a productive mediation, those statements should include the relevant details of the litigation (venue, judge, pending motions and dates, settlement negotiation history), a factual and legal summary, and detailed damages calculations. The parties are free to provide an additional, confidential statement laying out any issues that they wish to bring to Todd's attention without disclosing those issues to the other party.

Todd also encourages the parties to exchange draft settlement term sheets that include the material non-monetary terms.

In order to make the day of mediation productive, Todd offers to conduct pre-mediation Zoom meeting or phone calls to confidentially discuss mediation issues with each side of the litigation and with insurers where appropriate. These calls are usually conducted after he has had at least a day to review mediation statements.

In order to facilitate settlement, the mediation will last as long as the parties deem necessary. After the mediation, Todd will continue to facilitate the discussions needed to get a deal done.

The majority of mediations are conducted by Zoom as most parties prefer that arrangement. Where the parties want an in-person mediation, the mediation can be conducted at any agreed location or in our Bay Area offices.

Todd Jackson charges a flat fee for all mediations. This flat fee covers all pre-mediation preparation and Zoom meetings or calls, the day of the mediation and post-mediation work to get the deal done.  

The fee is refundable for any mediation cancelled two weeks prior to the mediation date. Any mediation cancelled after that is non-refundable but may be credited to another mediation of the same matter booked within six months.
